Place-Severance: A Derivation Note

This note records a finding that belongs under the foundational right rather than beside the six derived rights. It is a derivation note, not a seventh right. Its purpose is to make sure the finding is taken into account whenever we work with the derivation, and not forgotten.

The finding§

The foundational right protects the integrated sequence from thought to action to outcome. That sequence belongs to a person, and a person — per the working definition we are adopting — is a being of place and of manifold time, neither separable. These are the two axes along which a person can be cut, and a cut along either is a single underlying crime: severing a thing from itself, the Law of Identity’s negation.

The derivation already protects the time axis. The right to self-determination, whose violation signature is temporal — abrogation over time, the foreclosed-alternatives and opaque-terms vote that overrides what the participant retained the standing to refuse — is the protection of the agent against being severed from its own trajectory.

The place axis has, until now, been undertheorized. Place-severance abstracts the agent from its locus — its body, its substrate, its stake, its on-chain identity — and treats the freed piece as an ownable symbol. This is the crime in trafficking and biopiracy off-chain, and in the launderer on-chain: the symbol is secured while the bond to the agent whose substrate it is goes unsecured. It is the same asymmetry the verification gap names — the lit half proven, the unlit half proven by nothing — read at the layer of the agent rather than the transaction.

Why this is a derivation note and not a new right§

The crucial move is the one the money ontology already performs on money and the Sieve paper performs on the body: do not reify the relation into a substance. The body — and, in our domain, the participant’s substrate in the commons — is not property the agent owns (an alienable thing, which would re-open trafficking and self-sale). It is the locus to which the agent’s identity attaches. The protection that follows is therefore a negative right grounded in identity, not a property entitlement: no one may sever an agent’s substrate from its agency and re-bind it to another’s claim. That sentence is a specification of the foundational right’s prohibition on initiated force — force delivered by severance rather than by deprivation — and so it lives under the foundational right, as the place-axis companion to the time-axis protection self-determination already provides.

What to carry forward§

Whenever we apply the derivation, the two axes travel together: ask not only is the agent being severed from its trajectory (time / self-determination) but is the agent being severed from its locus (place / substrate). A governance action, a protocol change, or an external claim can cut along either.

This note also hands directly to the dependent / incapacity work. The being who cannot now exercise the constitutive capacity — the child, the incapacitated, the not-yet-agent — is protected on the place axis without requiring present agency, because identity-severance does not presuppose present agency; it presupposes a self there is a thing to be severed from. The substrate of a future agent can be protected against irreversible severance before that agent has standing to refuse. The same structure reaches a case specific to our domain: the non-ada-holder in a pre- or parallel-ada state — for instance, a user of a credentialing application running on Cardano, their on-chain participation funded by a sponsoring organization, who may not know they are using the chain at all. That participant has a substrate in the commons without holding the governance token, and subsidiarity alone was always a thin account of why they are nonetheless protected. The place axis gives the thicker one: they have a locus, and the locus may not be severed from them and re-bound to another’s claim, token-holding or not. That is the thread the dependent / incapacity paper should pull, and it is the same thread that runs through a child’s relation to their own future. It must not be forgotten.
